Wherever possible our terms and conditions are written in plain English and are designed to be fair both to you the trainee and ourselves the trainers

If you have any doubt as to the meaning or understanding of them or you feel they are unfair please contact ourselves prior to ordering any training course or product. It is your responsibility to ensure that you have fully understood them and any financial or other implication they may hold for you.

Before agreeing to these terms and conditions you may book a “ taster “ driving lesson with your course instructor, you are not committed to purchasing the course at this stage, you will not be charged for the taster lesson. If you have prepaid for the course prior to this lesson your money will be held on account until you advise us that you want or do not want to book the course. If you do not want to book the course after your taster lesson you may ask for a refund in full or you may commute part or all of your money into standard lessons,

 

  1. The course must be paid for in full at the time of booking
  2. A client may in certain circumstances obtain a refund in full up to the commencement date of the course   where the DVLA have refused the client’s right to hold a provisional licence on medical grounds   and the condition had been medically diagnosed prior to the course commencement date.  Confirmation of the DVLA refusal to issue or retract an existing licence must be provided prior to the refund being made.
  3. Loss of licence by means of road traffic offences or criminal activity or by any other means other than detailed in 3) will not allow the course to be cancelled outside of the cancellation period as detailed in 2) no refund will be allowed in these circumstances
  4. We will consider all requests for cancellation and refund at any time up to the commencement date of the course and will look upon the merits  of the individual request  without prejudice
  5. A change of instructor is not normally possible once the course has commenced
  6.  Tuition will start at the agreed time and place, this may be changed at any time subject to agreement between the pupil and the instructor.
  7.  in the case of trainees under 18 years of age our contract  will be with the responsible adult with whom the agreement is made
  8. Any disagreement should be taken up with the driving instructor or with the school itself . The school promises to account for any money paid directly to the school, however as our instructors are franchisees and are self employed any monies paid to the instructor constitute a contract between the instructor and the client  and we cannot account for monies paid to the instructor. We do however accept responsibility for instructors upholding our code of practice.
  9. In addition to any cancellation rights we have mentioned elsewhere, the distance selling regulations 2000 may apply if you have not met us in person to discuss your tuition before your first lesson and for the avoidance of doubt, we explicitly acknowledge your right to cancel your contract with us up until the time your first lesson begins, or seven working days from when we give you this document, whichever is the sooner
  10. If the  training session is cancelled at short notice due to adverse weather or road conditions by your trainer then your training will be rescheduled  without charge to you  but you will not be entitled to compensation for travelling or otherwise
  11. You must be able to read a number plate at 20.5m and produce both parts of your driving licence or photographic id and the old paper style licence at your first in car training session. If you cannot do either of these things you will not be allowed to commence in car training until you can do so, and you will be charged for the cancelled training session
  12. You must be in a fit and proper state to drive a motor vehicle. If in the trainer’s opinion you are not fit to drive through but not limited to illness, tiredness, attitude, alcohol or drugs, your trainer in concern for health and safety may refuse to train you or may at any time terminate your training session
  13. In extreme circumstances if the instructor is being threatened or is subject to verbal or physical abuse  you will be asked to leave the vehicle, irrespective of where you are, the training will terminate at that point and the remainder of the course will be cancelled  and no money will be refunded.  If you are under 18 years of age  and we ask you to leave the vehicle we will contact your parents or responsible adult and ask them to collect you, we will ask you to wait at the tuition vehicle until they arrive, however we cannot be held responsible if  the trainee refuses to wait
  14. All training will be conducted in the trainer’s car which will be mechanically  safe and functioning, the car will be clean   and presentable inside and out and will be fitted with dual brake, clutch  and interior mirror. The car will have fully comprehensive car insurance  which covers all drivers, including the DSA examiner and trainee during training and the DSA  tests, this includes  legal cover
  15. The trainer is self employed and will have their own public liability and indemnity insurance policy
  16. Clients must be aged between 17 years and 26 years of age when the course commences, unless otherwise agreed.
  17. Clients should be available for driving tuition each week at the rate advised by the instructor (in the event of illness or injury, the course may be suspended for up to 6 weeks at the School’s discretion. After  6 weeks absence, monies paid will be converted to normal hourly tuition rates and used as an advance payment against future tuition fees, after first deducting test fees, booked on your behalf, and driving tuition already provided at the prevailing rate in force at the time of booking and any learning aids provided to you at cost
  18.  Clients must be in possession of a current valid UK provisional driving licence.
  19. Clients must be capable of learning to drive in a standard manual category B car
  20. Clients must act in a mature and responsible manner whilst learning to drive; otherwise the course may be cancelled without any refund of fees
  21. Clients should declare any learning or physical disability which would affect their capability to successfully learn to drive. Failure to disclose relevant information may result in the course being cancelled without any refund of fees (monies paid will be converted to normal hourly tuition rates and used as an advance payment against tuition fees)
  22. If a client cancels a period of tuition within 24 hours then a cancellation fee equivalent to the current published price of an hours driving lesson calculated pro rata to the length of driving lesson cancelled will be chargeable over and above the cost of the course, this fee to be paid to the instructor at the next appointment.
  23. A maximum of four test attempts in total are included free of charge either theory or practical, additional tests are chargeable at cost prior to booking
  24. If a client fails to attend or cancels a test within seven days of the test date this will count as a test attempt
  25. The choice of driving test  centre  will be  that of the driving school and will depend on where the course is taking place and availability of test dates and times when booking the driving course.
  26. You must sign a declaration when attending a driving test that you have lived in the UK for at least 185 days in the last 12 months. This is a legal requirement.
  27. The theory test should be passed by the time fifteen hours tuition is taken or within three months of commencing the course whichever is the sooner; otherwise your tuition may be reduced or suspended until such time as the theory test is successfully completed.
  28. There is no limit on the amount of tuition to be provided  to help you become a safe confident and competent driver and to pass the driving test  but there is a time limit of twelve months which can be extended by six months on request in  writing within the twelve month period and providing the client follows the course terms and conditions and  the client has not passed the driving test
  29. The actual amount of instruction given will be at the discretion of the instructor but will be sufficient to produce a safe competent and confident driver capable of passing the category B driving test.
  30. The course ends when the client  passes the category B manual driving test
  31.  Dvd rom learning aid for theory test to be provided  (please specify windows or Mac operating system)
  32. The course fee is a total price to learn to drive
  33. The periods of driving tuition may vary in length  and may not conform to standard driving lesson times of 60 minutes, 90 minutes or 120 minutes.
  34. The course fee does not represent an hourly rate for driving tuition
  35. Use of the car for practical tests will be provided irrespective of the number of tests attempted
  36. No additional charges will be made to  you except as detailed in these terms and conditions
  37. The training element will be subcontracted to one of our franchisees
  38. Cancellation can be made at any time but no refund can be made once the course has commenced
  39. In the event of dispute or disagreement between your instructor and yourself the decision of Jenny Hayes School of Motoring will be final and binding. This does not override any rights you may have in law
  40. You may complain at any time to the Jenny Hayes School of Motoring , 2 Arundel Terrace,  however you may complain to the school by telephone 01288 35233, by e mail hayes-d@ bt connect .com or in writing at any time, we will endeavour to reply to your complaint within 48 hrs  if further investigation is needed to resolve the matter then we will inform you within 48 hrs with a revised timescale to respond fully to your complaint
  41. Wherever possible you will receive driving tuition from the same instructor however we reserve the right to change instructors at any time
